Zenith Point Innovations LLC respects your privacy. This Privacy Policy explains how we collect, use, store, disclose, and protect information when you access or use Orpheix.
“Zenith,” “we,” “us,” or “our” means Zenith Point Innovations LLC.
“Orpheix” or the “Service” includes the Orpheix mobile application, associated websites, desktop software, web services, point-cloud tools, spatial-capture tools, measurement features, subscription services, file-sharing features, and related services provided by Zenith Point Innovations LLC.
By accessing or using Orpheix, you acknowledge the practices described in this Privacy Policy.

INFORMATION WE COLLECT
The information we collect depends on how you use Orpheix, the features you access, your subscription status, your device settings, and the permissions you provide.
A. Account Information
When you create or use an Orpheix account, we may collect:
• Your name.
• Your email address.
• Your account identifier.
• Login and authentication information.
• Account preferences.
• Subscription status.
• Organization or company information, if provided.
• Information associated with account creation, verification, access, support, and deletion.
If you sign in using a third-party authentication provider, such as Sign in with Apple, we receive only the information made available by that provider based on your settings and permissions.
If you use Apple’s Hide My Email feature, we may receive a private relay email address instead of your personal email address.
B. User Content and Spatial Data
Orpheix may allow you to create, capture, import, upload, process, view, store, organize, measure, export, download, or share:
• Point-cloud files.
• Spatial captures.
• LiDAR information.
• Depth information.
• Photographs and images.
• Measurements and annotations.
• Three-dimensional models.
• Project names and descriptions.
• Files imported from your device.
• Files created or exported through Orpheix.
• Information you voluntarily include in a file, capture, model, or project.
This information is referred to as “User Content.”
User Content may contain information about buildings, rooms, property, equipment, infrastructure, objects, people, or other physical environments.
You are responsible for ensuring that you have all necessary rights, permissions, and lawful authority to capture, upload, process, store, and share User Content.
C. Camera, Photos, Files, and Sensor Access
Depending on the features you use, Orpheix may request permission to access:
• Your device camera.
• Your photo library.
• Files stored on your device.
• LiDAR sensors.
• Depth sensors.
• Motion or spatial sensors.
• Local device storage.
• Bluetooth or nearby-device functionality when required by a supported feature.
• Location information when required by a feature and when you grant permission.
Orpheix accesses these device features only when you provide permission or actively use a related feature.
You may manage or disable device permissions through your device settings. Disabling a permission may prevent certain Orpheix features from working correctly.
D. Location Information
Orpheix may collect precise or approximate location information only when a feature requires location access and you grant permission.
Location information may be used to associate a capture or project with a location, organize project information, or provide another feature you request.
You can disable location access through your device settings. Location-based features may not work when location access is disabled.
E. Purchase and Subscription Information
If you purchase an Orpheix subscription through Apple, Apple processes your payment information.
Zenith does not receive your complete credit-card number, bank-account number, or full payment details from Apple.
We may receive limited purchase and subscription information, including:
• The subscription product purchased.
• Subscription status.
• Purchase or transaction identifiers.
• Original transaction identifiers.
• Purchase date.
• Renewal or expiration information.
• Whether a purchase was restored.
• App Store country or storefront information.
• Refund, cancellation, or billing-status information.
• Subscription entitlement information.
We use this information to verify purchases, restore purchases, prevent fraud, and provide access to paid features.
F. Device and Technical Information
When you use Orpheix, we may automatically collect limited technical information, including:
• Device type and model.
• Operating-system type and version.
• Orpheix app version.
• Device language and regional settings.
• General device configuration.
• Internet Protocol address.
• Internet connection information.
• App installation identifiers.
• Authentication or session identifiers.
• Crash reports.
• Error logs.
• Diagnostic information.
• Performance information.
• Dates and times of access.
We use this information to operate, secure, troubleshoot, maintain, and improve Orpheix.
G. Usage Information
We may collect information about how Orpheix is used, including:
• Features accessed.
• Screens or controls used.

• File-processing events.
• Import, upload, export, or sharing activity.
• Subscription-feature usage.
• Errors encountered.
• General app interaction and performance information.
We limit this information to what is reasonably necessary to understand app performance, maintain security, and improve the Service.

When you contact us, request support, report a problem, or provide feedback, we may collect:

• The contents of your message.
• Files, screenshots, or logs you provide.
• Information about your device or app version.
• Records of our communications with you.
Please do not send confidential project information unless it is necessary for us to respond to your request.
HOW WE USE INFORMATION

• Provide Orpheix features and services.
• Process, store, display, export, and share User Content at your direction.
• Verify purchases and provide subscription access.
• Restore purchases across supported devices or platforms.
• Respond to support requests and communications.
• Diagnose and resolve technical issues.
• Monitor app reliability, security, and performance.
• Detect fraud, misuse, security threats, or unlawful activity.
• Protect Orpheix, our users, and our systems.
• Improve existing features.
• Develop new features and services.
• Communicate important account, subscription, security, or policy information.
• Enforce our Terms of Use.
• Comply with legal obligations.
• Protect the rights, safety, and property of users, Zenith, and others.
We do not use private User Content to train publicly available artificial-intelligence models unless we clearly disclose that use and obtain any consent required by applicable law.
LEGAL BASES FOR PROCESSING
Where applicable law requires a legal basis, we process personal information under one or more of the following grounds:
A. Performance of a Contract
We process information when necessary to provide Orpheix, manage your account, verify your subscription, process your files, and provide the services you request.
B. Legitimate Interests
We may process information to operate, secure, maintain, troubleshoot, analyze, and improve Orpheix, provided those interests are not overridden by your rights.
C. Consent
We rely on your consent when requesting optional device permissions or where consent is otherwise required.
You may withdraw consent through your device settings or by contacting us. Withdrawing consent does not affect processing that occurred before the withdrawal.
D. Legal Obligations
We may process information when necessary to comply with laws, regulations, court orders, legal proceedings, or valid governmental requests.
HOW WE SHARE INFORMATION
We do not sell or rent personal information.
We do not use personal information for cross-context behavioral advertising.
We may disclose information in the following circumstances:
A. Service Providers
We may use service providers to help operate Orpheix, including providers of:
• Cloud hosting and storage.
• Account authentication.
• Subscription management.
• Payment and purchase verification.
• App diagnostics and crash reporting.
• Email and customer support.
• Security and fraud prevention.
• Website hosting.
• Software infrastructure.
These service providers may process information only as reasonably necessary to provide services to Zenith and are expected to protect the information appropriately.
B. Apple and Payment Platforms
Purchases made through Apple are processed under Apple’s terms and privacy practices.
We may exchange purchase identifiers, subscription status, and entitlement information with Apple or an authorized subscription-management provider to verify purchases and manage access to paid features.
C. Information You Choose to Share
Orpheix may allow you to export or share files through email, text messaging, cloud-storage services, file-sharing services, or other applications.
When you choose to share information with another person or service, that information becomes subject to the recipient’s privacy practices.
Zenith is not responsible for how recipients or third-party services use files that you choose to share.
D. Organizations and Account Administrators
If your account is created, purchased, or managed by an employer, client, school, government agency, or another organization, authorized administrators may be able to manage your account or access information associated with the organization’s projects.
Any organizational access may also be governed by a separate agreement between Zenith and the organization.
E. Legal and Safety Reasons
We may disclose information when we reasonably believe disclosure is necessary to:
• Comply with applicable law.
• Respond to a valid subpoena, court order, or governmental request.
• Investigate fraud, misuse, security incidents, or unlawful activity.
• Protect the rights and safety of users, Zenith, or others.
• Enforce our Terms of Use.
• Establish, exercise, or defend legal claims.
F. Business Transfers
If Zenith is involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar transaction, information may be transferred as part of that transaction.
Any recipient will remain subject to applicable privacy obligations.
USER CONTENT OWNERSHIP
You retain ownership of the User Content you create, import, upload, or process through Orpheix.
You authorize Zenith to process User Content only as reasonably necessary to:
• Provide the features you request.
• Store or transmit files at your direction.
• Secure, operate, and maintain the Service.
• Provide technical support.
• Comply with legal obligations.
• Perform other activities described in this Privacy Policy.
Zenith does not claim ownership of your point clouds, spatial captures, photographs, measurements, models, or project files.
SENSITIVE SPATIAL INFORMATION
Point clouds, photographs, measurements, and spatial files may reveal sensitive information about private property, buildings, security features, infrastructure, equipment, or individuals.
Before capturing, uploading, or sharing spatial information, you should:
• Obtain permission from the property owner or another authorized party.
• Avoid capturing individuals without an appropriate legal basis.
• Remove information that is not necessary for your project.
• Use appropriate file-sharing and account-security controls.
• Follow applicable privacy, workplace, property-access, and recording laws.
• Avoid uploading classified, export-controlled, legally restricted, or highly confidential information unless Zenith has expressly agreed in writing to support that information.
You are responsible for deciding whether Orpheix is appropriate for the sensitivity of your project and information.
DATA STORAGE AND RETENTION
We retain personal information only for as long as reasonably necessary to:
• Provide Orpheix.
• Maintain your account.
• Fulfill the purpose for which the information was collected.
• Resolve disputes.
• Enforce agreements.
• Maintain security.
• Prevent fraud.
• Comply with accounting, tax, legal, or regulatory obligations.
User Content may be retained while your account is active or until you delete the content, delete your account, or request deletion.
Some information may temporarily remain in encrypted or secured backup systems after deletion. Backup copies may be removed or overwritten according to normal backup schedules unless longer retention is legally required.
We may retain limited transaction, fraud-prevention, security, and legal-compliance records after account deletion where permitted or required by law.
You should maintain independent backup copies of important User Content. Orpheix should not be used as the only storage location for irreplaceable project data.
ACCOUNT AND DATA DELETION
You may request deletion of your Orpheix account and associated personal information through the account-deletion option inside the app, when available, or by contacting:

Before completing a deletion request, we may need to verify your identity and account ownership.
Deleting your Orpheix account does not automatically cancel an active Apple subscription. Apple subscriptions must be managed separately through your Apple Account subscription settings.
Following a verified deletion request, we will delete or de-identify information associated with your account unless retention is required or permitted for legal, security, fraud-prevention, payment, accounting, or dispute-resolution purposes.
YOUR PRIVACY CHOICES
Depending on your location and applicable law, you may have the right to:
• Request access to personal information we maintain about you.
• Request correction of inaccurate information.
• Request deletion of personal information.
• Request a portable copy of certain information.
• Object to or restrict certain processing.
• Withdraw consent.
• Appeal certain privacy-request decisions.
• Submit a complaint to an appropriate privacy or data-protection authority.

Zenith does not sell personal information.
Zenith does not share personal information for cross-context behavioral advertising.
We will not unlawfully discriminate against you for exercising an applicable privacy right.

Zenith is based in the United States.

DATA SECURITY
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information.

CHILDREN’S PRIVACY
Orpheix is not directed to children under 13, and we do not knowingly collect personal information from children under 13.

If we learn that we collected personal information from a child in violation of applicable law, we will take reasonable steps to delete it.
THIRD-PARTY SERVICES AND LINKS
Orpheix may contain links to or integrate with third-party services.
Third parties operate under their own terms and privacy policies. Zenith does not control and is not responsible for the privacy, data-handling, security, or content practices of third-party services.
You should review the privacy policy of any third-party service before providing it with information.
COOKIES AND WEBSITE TECHNOLOGIES
The Orpheix or Zenith website may use cookies, local storage, server logs, or similar technologies to:
• Operate website features.
• Remember preferences.
• Maintain security.
• Understand general website performance.
• Diagnose technical issues.
You may be able to control cookies through your browser settings. Disabling cookies may prevent certain website features from working correctly.
DO NOT TRACK
Some browsers offer a “Do Not Track” setting. Because there is not one universally accepted standard for responding to these signals, our website may not respond to every Do Not Track signal.
We do not use personal information for cross-context behavioral advertising.
EMAIL COMMUNICATIONS
We may send service-related communications concerning:
